By downloading, installing, or using the Otomorph application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Otomorph SAS ("Otomorph," "we," "us," or "our"). If you do not agree to these Terms, do not use the App.
Otomorph is a vehicle management platform that provides, among other features:
Vehicle digital twin and maintenance record tracking.
AI-powered personal mechanic assistant (the "AI Garagist").
Document scanning and predictive maintenance alerts.
Real-time vehicle market valuation and health scoring.
Blockchain-verified vehicle history (optional Web3 features).
Subscription-based premium features (Otomorph Plus).
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Subscriptions & Billing
A. Free and Paid Plans
Otomorph offers a free Starter plan and a paid Otomorph Plus plan. The features included in each plan are described within the App and may be updated from time to time.
B. Billing and Payment
All purchases and subscriptions are processed exclusively through the Google Play Store. Otomorph SAS never directly collects, stores, or processes your payment card information. By subscribing, you also agree to Google Play's Terms of Service.
C. Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. The renewal charge is made within 24 hours before the end of the current period.
D. Cancellation
You can manage and cancel your subscription at any time through your Google Play Store account settings. Cancellation takes effect at the end of the current billing period; you retain access to Plus features until that date.
E. Price Changes
Otomorph may change subscription prices. We will provide reasonable advance notice of any price increase. Your continued use of the subscription after the change takes effect constitutes your acceptance of the new price.
F. Refunds
Refund requests are handled by Google Play in accordance with their refund policy. Otomorph does not directly process refunds.

AI Garagist — Important Disclaimer
The AI Garagist feature provides informational and educational content about vehicle maintenance. It is powered by Google Gemini (enterprise tier).
Not Professional Advice: The AI Garagist is not a substitute for advice from a certified, licensed mechanic or automotive professional. Information provided is for general guidance only.
No Liability: Otomorph is not liable for any loss, damage, injury, or cost arising from decisions you make based on AI-generated content within the App.
Safety-Critical Issues: For any issue you believe may affect the safety of your vehicle or passengers, you must consult a qualified mechanic immediately. Do not rely solely on the AI Garagist for safety-critical decisions.
Data Use: Your prompts are processed by Google Gemini under the enterprise agreement, which means they are not used to train public AI models. See our Privacy Policy for details.

Vehicle Valuation & Data Accuracy
Vehicle valuations, health scores, market trend data, and predictive maintenance suggestions provided by the App are estimates based on available market data and your vehicle's records.
Not a Certified Appraisal: These figures are not certified appraisals and should not be the sole basis for any buying, selling, or financial decision.
No Guarantee of Accuracy: Market conditions change rapidly. Otomorph does not guarantee the accuracy, completeness, or timeliness of valuation data.
Informational Only: All predictive maintenance alerts are informational. Always have your vehicle inspected by a professional for any mechanical concerns.

Blockchain Features & Digital Wallet
Certain features of the App involve blockchain technology (IOTA network) and a non-custodial Web3 wallet.
Self-Custody Wallet: The wallet created during onboarding is non-custodial. You hold the private keys directly on your device. Otomorph does not have access to your private keys and cannot recover them if lost. It is your sole responsibility to back up your recovery phrase or key file.
Loss of Keys: If you lose your private keys or backup file, your blockchain assets (NFTs, DID) may be permanently inaccessible. Otomorph bears no liability for such loss.
Optional Features: All blockchain write operations (anchoring records, notarizing documents) are entirely optional. You can use the App's core features without using Web3.
No Financial Advice: Nothing in the App constitutes financial, investment, or tax advice regarding blockchain assets or NFTs.
You agree to:
Provide accurate and truthful information when creating your account and managing your vehicle data.
Keep your login credentials secure and notify us immediately of any unauthorized account access.
Use the App only for lawful purposes and in accordance with these Terms.
Not upload or submit content that is false, fraudulent, illegal, or infringes the rights of any third party.
Not attempt to reverse-engineer, decompile, or exploit any part of the App or its infrastructure.
The Otomorph App, its design, code, trademarks, and all related content are the exclusive property of Otomorph SAS and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App or its content.

Limitation of Liability
To the fullest extent permitted by applicable law:
The App is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.
Otomorph is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to data loss, service interruptions, or inaccurate vehicle data.
Otomorph is not liable for failures or outages of third-party services it relies on, including Google Cloud, Google Play, or the IOTA network.
Our maximum total liability to you for any claims arising from these Terms shall not exceed the total amount you paid to Otomorph in the twelve (12) months preceding the claim.
By You: You may delete your account at any time from within the App. Upon deletion, your data will be processed in accordance with our Privacy Policy.
By Us: We reserve the right to suspend or terminate your account immediately, without prior notice, if we determine that you have materially violated these Terms.
Effect of Termination: Upon termination, your license to use the App is revoked. Any active subscription must be separately cancelled through Google Play.
11.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of France. Any dispute arising from or related to these Terms or your use of the App that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Versailles, France.
As a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
12.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notification. Your continued use of the App after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and may delete your account.
